Dear Senator Cordrey:
You have asked for an interpretation of the word "employee" as contained in 19 Del. C. § 1602(l) as amended by 70 Del. Laws ch. 163. This interpretation will allow towns in Sussex County to determine whether the provisions of the Police Officers' and Firefighters' Employment Relations Act (hereinafter "the Act") applies to them as a result of the amendment. Specifically, your question is whether "25 or more full-time employees" means "25 members of the police and/or firefighters, or does it mean 25 employees of the town as a whole."
